The Massachusetts Chapter of Enrolled Agents is a chapter of the National Association of Enrolled Agents (NAEA) – the only professional association representing Enrolled Agents (EAs) in Massachusetts. Section 91 of the Governor’s FY25 budget called for another short-lived DOR Amnesty Program. It has been ten years since the last MA tax amnesty program. The 2024 Amnesty Program begins on November 1st and ends on December 31st. MA DOR will reach out to some of the qualified taxpayers. Qualifying taxpayers may have tax penalties waived, if they apply for tax amnesty during this period and if they pay the tax liability in full before December 31st. Taxpayer with unfiled returns, amended tax liabilities and those with open and pending cases might be eligible. Taxpayers who received amnesty in the most recent program in 2015 are not allowed a second bite of the apple. Also ineligible are taxpayers who have already paid a tax in full, are in bankruptcy, have committee fraud or seek a refund. Details and FAQ’s are available on the DOR website.
Pat Boutilette, EA cautions MAcEA members that scammers have constructed US Treasury simulated forms, (5102 & 4022 are the most common), with a $117 or $119 fee to report properly Beneficiary Ownership Information, (BOI), details. Direct your clients to immediately throw these offers away. Unwary LLC’s and S-Corps will turn over personal identifying information of the owners to non-legitimate solicitors.
In 2024, all US businesses that were once created by filing documents before a state entity are required to report their ownership information at the federal level using the FinCen.gov/BOI website. Failure to timely file this information subjects the business to a daily $500 civil penalty and possible criminal prison time. There is no fee to file the BOI report online. There is no method to file the BOI report by mail. More information about legitimately filing BOI reports and this scam can be found on the FinCen.gov/BOI website.
MAcEA collaborates with the East Cambridge Savings Bank a free public event: “Taxpayer Review/Preview Day” at four branches in Arlington, Cambridge, Woburn and Belmont on Saturday, November 2nd from 9:00 AM to 1:00 PM. The bank will promote the event and sign-up customers. Any member interested in more information should call John Warren, EA at (781) 219-4206.
The MAcEA seeks to resuscitate this volunteer group that supports all New England Low Income Tax Clinics. The NH clinic, 603 Legal Aid, has 25 cases of incarcerated individuals who seek stimulus money. Some are open cases for 2020 EIP that need to be wrapped up and the rest are 2021 claims.
